			<content:encoded><![CDATA[<p>The ink hadn&#8217;t had time to dry on the ruling by the <a title="texas supreme court overturns lower court ruling on flds raid" href="http://www.dirtfromtexas.com/texas-supreme-court-orders-flds-kids-back-to-parents-says-cps-went-too-far/" target="_self">Texas Supreme Court&#8217;s decision</a> that overturned <strong>Judge Barbara Walther</strong>&#8217;s incompetent ruling that allowed CPS to snatch up over 400 FLDS kids than she and the CPS lawyers showed their arrogance again by delaying the re-uniting of the FLDS kids with their parents.</p>
<p>This latest snag just goes to show how arrogant and incompetent both Judge Barbara Walther and the Texas CPS are. Both came up with an &#8220;agreement&#8221; that they are trying to force the parents to sign in order to get their children back.</p>
<p>Funny, I don&#8217;t remember either the District Court or the Supreme Court issuing a ruling that the FLDS parents must sign such an agreement to get their kids back. I do remember both higher Courts saying that Judge Barbara Walther was wrong when allowing the CPS to swoop in and kidnap those kids away from their parents.</p>
<p>Apparently neither <strong>Judge Barbara Walther</strong> or CPS have learned their lesson. This is just another example of a incompetent judge in our legal system trying to have her way regardless of what higher courts decide.</p>
<p>Here&#8217;s just a snippet from an <a href="http://news.yahoo.com/s/ap/20080531/ap_on_re_us/polygamist_retreat" target="_blank">Associated Press article on Yahoo</a>.</p>
<blockquote><p>Under the deal CPS released, the families won&#8217;t be able to leave Texas until Aug. 31 but would be allowed to move back to the ranch. It also calls for parenting classes and visits by CPS to interview children and parents in the <span id="lw_1212207607_12" class="yshortcuts">child abuse investigation</span>.</p>
<p>Walther wanted to remove the August deadline and provide for psychological evaluations of the children. She also wanted it specified that parents can&#8217;t travel more than 60 miles from their residence without 48 hours&#8217; notice. She also wanted CPS to have access to the ranch and the children at all times necessary for any investigation.</p></blockquote>
<p>I don&#8217;t remember either higher Court issuing these restrictions? Obviously Judge Walther is still smarting by having her decision publicly overturned so now she&#8217;s reaching for straws. These are just the type of lawyers that need to be run out of the Public courts.</p>
<p>So now the Parents reunification with their Children are on hold as once again, the attorney&#8217;s for the FLDS parents and kids have to go back to the Court&#8217;s and have them direct this incompetent Judge Walther to do her job and return the kids&#8230;with no strings attached.</p>
<p>She&#8217;s trying to impose restrictions and limitations to parents in a case where she had <a title="high court overturns lower court case on flds raid" href="http://www.dirtfromtexas.com/texas-appeals-court-says-the-state-had-no-right-to-take-flds-kids/" target="_self">no authority to act in the first case</a>. A decision that all of her peers have agreed was wrong. Apparently she just can&#8217;t accept that fact.</p>
<p>If you remember right, the whole basis for the search warrant and raid were based on faulty and suspicious circumstances. Even knowing this, both the Judge and CPS have moved forward in their attempts to enforce their will on the FLDS parents and children.</p>
<p>This kind of Governmen abuse needs to stop now and the Government parties involved, including CPS lawyers and decision makers, along with <strong>Judge Barbara Walther</strong>, need to be held responsible for their incompetent and illegal actions.</p>

			<content:encoded><![CDATA[<p>I was happy to hear that our beloved <a title="texas supreme court" href="http://www.dirtfromtexas.com" target="_self">Texas Supreme Court</a> ruled that CPS overstepped their authority and ordered the FLDS kids to be reunited with their families. Yesterday, the <a title="texas supreme court " href="http://www.dirtfromtexas.com/texas-appeals-court-says-the-state-had-no-right-to-take-flds-kids/" target="_blank">Texas Supreme Court agreed with a lower court</a> that CPS went above their authority when the snatched the FLDS kids away from their parents. Isn&#8217;t it a shame that most of us already knew that and it took the Texas Supreme court to make the State of Texas aware of that?</p>
<p>Now let&#8217;s see if CPS can reunite the Families in a more organized way than when they kidnapped them. It was obvious for anyone who followed the FLDS raid that CPS didn&#8217;t have their heads screwed on straight to begin with. The didn&#8217;t know how many kids they had, whether or not the kids were actually kids or young adults and they didn&#8217;t know who was family and who wasn&#8217;t. I&#8217;m also wondering if this will stop the DNA testing of the kids?</p>
<p>It&#8217;s not common for the Courts to reign in out-of-control government departments like CPS, but I&#8217;m glad the Texas Supreme Court did. Now if they would just get some gonads and treat all cases as fairly as they did this one, this State would be in a much better shape than it is.</p>
<p>You can bet that the CPS will continue to hound the FLDS members. They&#8217;re not likely to get spanked and publicly humiliated like this and keep a low profile, No, I&#8217;d say we&#8217;ll see more gross incompetence from this Department in the days to come.</p>
<p>I sincerely believe the outcry not only from Texas citizens, but from the Country as well, played as much a part in the <strong>Texas Supreme Court</strong>&#8217;s decision than the law did. If we&#8217;d never heard of the raid on the ranch, I&#8217;m willing to bet good money that this decision would have been different. All that matters now is that the State of Texas must return the kids to their families. For once, justice was on the side of the citizen!</p>

			<content:encoded><![CDATA[<p>I put off writing this since this news story broke because I&#8217;ve been so PO&#8217;d I couldn&#8217;t see straigt. It&#8217;s still hard to write about it, but here goes.</p>
<p>I was reading several blogs today and was happy to see that I wasn&#8217;t the only one upset at the way our Texas Stormtroopers raided and subsequentially handled the raid on the <strong>Fundamentalist Church of Jesus Christ of Latter Day Saints</strong> compound.</p>
<p>This raid and the way Texas is treating the Families is wrong in so many ways. And what&#8217;s worse is the lack of Media attention this bungled raid is getting.</p>
<p>From the beginning there have been some serious questions needing answered by the State of Texas.</p>
<ol>
<li>Where is the girl who supposedly called? It&#8217;s been over two weeks and the authorities can&#8217;t produce this &#8220;girl&#8221; who called the abuse center. Hmmmm</li>
<li>If these girls were so bad off as the State of Texas says, then how is it that a 16 year old girl has a cell phone and the number to the abuse center?</li>
<li>Where is the recording of the call? Would the State of Texas please release the recording?</li>
<li>Why haven&#8217;t there been any arrest of the Males who alledgedly had sex with these girls? It&#8217;s been over two weeks but no arrest. If this problem was as rampant as the Sheriff and the State of Texas makes it out to be, why are there no arrest?</li>
<li>Since when does the State of Texas execute search warrants on hearsay?</li>
<li>It was reported by Investigators that there were &#8221;lots&#8221; of pregnant teenage girls running around the compound, but since the raid, only 3 (possibly) have been found. Now they&#8217;re saying &#8220;they appeared to be &#8220;lots&#8221; of pregnant teenage girls!&#8221;</li>
<li>It now appears the wrong man was named in the affadavit. Way to go Texas!</li>
</ol>
<p>It&#8217;s pretty obvious Texas&#8217;s raid against the FLDS compound was as much a cluster f**k as the Federal Raid on Waco was, even more so when you see these peoples Constitutional rights being violated for no other reason than it being an election year and the &#8220;powers to be&#8221; not agreeing on how these people live thier lives.</p>
<p>Who&#8217;s next&#8230;the Amish? Menonites? Jews? Rednecks?</p>
<p>What kind of an outcry do you think would have gone up if this had been a Spanish compound or a compound full of Muslims? But since it was a bunch of Fundamentalist Mormom&#8217;s living like it was 1800, no freakin&#8217; problem.</p>
<h3>State of Texas violating Constitutional Rights of Kids and Families</h3>
<p>Since the State of Texas has no proof against anyone in the compound, they have resorted to performing DNA test on the kids from the FLDS compound.</p>
<p>Do you think they received permission from the Kids to do this? Do you think they received permission from the Parents? Who gave them permission?</p>
<p>Oh wait, that&#8217;s right. The State of Texas took these kids away from their parents so they could have the right to perform DNA test so they could try and find someone to charge.</p>
<p>This stinks to high Heavan and everyone from Greg Abott to the Sheriff and the Law Enforcement personel taking part should have their kids taken away and be thrown in jail. There&#8217;s a helluva lot more evidence against them than against the FLDS members they took.</p>
<h3>What about the Kids?</h3>
<p>Have you seen some of the conditions these kids were living in after the State of Texas took them away? Deplorable!</p>
<p>&#8220;We&#8217;re from the State, we&#8217;re here to save you&#8221; came to mind as I watched News footage of a buch of Kids in a shelter living elbow to elbow. How scared many of the Kids must have been.</p>
<p>It&#8217;s also no secret how the State of Texas deals with Kids in these situations. There&#8217;s been more than one News show documenting how the State puts these Kids on a variety of mind altering drugs.</p>
<p>You also don&#8217;t have to look far to find how grossly incompetent that CPS and their Investigators are.</p>

<p>So who do you think is a bigger threat to the Kids now?</p>
<h3>Texas Releases the FLDS Raid Affadavit</h3>
<p>I just read the FLDS Raid affadavit over on Guy Murray&#8217;s, <a href="http://messengerandadvocate.wordpress.com/2008/04/09/texas-authorities-release-flds-raid-affidavit/" target="_blank">The Messenger and Advocate blog</a>. It&#8217;s more alarming than what I thought it would be. No hard evidence, just vague information and third party accounts.</p>
<p>This story just keeps sprouting legs and making not only the State of Texas look like the Jack Booted thugs they are in this case, but the local law enforcement, CPS and Judge ruling over the case as well.</p>

<p>I also found this link on Guy&#8217;s blog to <a href="http://www.bycommonconsent.com/2008/04/400-children/" target="_blank">Steve Evan&#8217;s blog</a>. This post has some of the most thoughtful comments I&#8217;ve seen so far on this matter. I&#8217;m glad to see that Texas can&#8217;t pull the wool over everyones eye&#8217;s.</p>
<p>And just for the record, I&#8217;m not a member or supporter of the FLDS or LDS. I think you can read this blog and figure that out. What I am is mad as hell that a branch of the Government can go and tear Families apart just becasue they don&#8217;t agree with how they&#8217;re living. In any other account, you couldn&#8217;t get the State to step in and take kids away from anyone on hearsay evidence. Not this time, they were more than happy to!</p>
